1 Introductory provisions
a) The publisher of these general terms and conditions (hereinafter referred to as "terms and conditions") is Diverze Group s.r.o., with registered office: Moyzesova 24/b, 900 28 Ivanka pri Dunaji, Slovak Republic, ID number: 51 932 750, VAT number: 2120841701, VAT number : SK2120841701.
b) Diverze Group s.r.o. is registered in the Commercial Register of the District Court Bratislava I, Section: Sro, Entry no. 131393/B, Department: Ltd. (hereinafter referred to as "the seller" or "Diverze Group s.r.o.").
c) These terms and conditions regulate business relations between the seller and a natural person who concludes a purchase contract outside of his business activity as a consumer, or within his business activity (hereinafter referred to as "buyer" or "participant") relating to the order of accesses to 3rd party providers, access to online databases, educational materials, publications, academies and possible educational events (hereinafter referred to as "databases" or "service") organized and/or delivered by Diverze Group s.r.o. via the website www.databasetogrow.com.
d) By accessing the website at databasetogrow.com, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.
2 General rights and obligations of the client and Diverze Group s.r.o.
a) Diverze Group s.r.o. undertakes to deliver the subject of the order (databases) to the buyer for payment.
b) Unless otherwise stipulated in these business terms and conditions and unless expressly agreed otherwise in writing, payment is made in advance to the bank account IBAN: SK44 1100 0000 0029 4306 1289 or through the payment gateway on the website, in this case, through the PayPal or Stripe payment gateway.
c) The payment is considered to have been made by crediting it to the account IBAN: SK44 1100 0000 0029 4306 1289.
d) Buyers of databases are guaranteed an access to the sources from the moment of confirmation of their duly completed order by Diverze Group s.r.o. and proper and timely receipt of the databases fee for the given buyer by Diverze Group s.r.o..
e) All materials provided to the buyer for the purpose of extending the database remain the property of Diverze Group s.r.o.
f) Diverze Group s.r.o. undertakes to make the highest possible effort to provide its clients with the highest quality and most effective insights in the database. Diverze Group s.r.o. however, it does not guarantee the success of its application and waives any responsibility in the event that the materials from the given database or educational materials were used in an unethical manner or incorrectly.
g) In the event that third parties/platforms, such as service providers where the databases are stored, are unable to continue providing these services, Diverze Group s.r.o. reserves the right to move all materials to another platform. However, at the same time, he will have the obligation to inform current customers about this step in advance and send them new approaches.
h) The materials on Diverze Group s.r.o.’s website are provided on an 'as is' basis. Diverze Group s.r.o. makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
i) Further, Diverze Group s.r.o does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
3 Order
a) The condition for the validity of the order is the true and complete filling in of all required data and information by the buyer.
b) Each order must contain: full name and surname of the buyer, postal and billing address, subject of the order, selected date and type of access, contact e-mail address.
4 Price and payment terms
a) Valid course prices are listed on the website of Diverze Group s.r.o. at www.databasetogrow.com. The price of the courses can also be set by mutual written agreement between Diverze Group s.r.o. and clients.
b) Payment conditions for repeated purchases can be modified by agreement of Diverze Group s.r.o. and the buyer deviates from the above, while all such agreements must be in writing and be legally confirmed by authorized representatives of Diverze Group s.r.o. and the buyer.
5 Limitations & Accuracy of materials
a) In no event shall Diverze Group s.r.o or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on buyer’s website, even if buyer or authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
b) The materials appearing on Diverze Group s.r.o.’s website could include technical, typographical, or photographic errors. Diverze Group s.r.o.’s does not warrant that any of the materials on its website are accurate, complete or current. Diverze Group s.r.o.’s may make changes to the materials contained on its website at any time without notice.
6 Links
a) Diverze Group s.r.o. has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Diverze Group s.r.o.’s of the site. Use of any such linked website is at the user's own risk.
7 Delivery Conditions
a) The place of the service is understood to be the place indicated in the confirmation of the order.
8 Warranty period, deadlines for making claims and claims from responsibility for service defects
a) The provided service is defective if it was not provided in accordance with the contract.
b) The buyer is obliged to make claims for defects in the provided service in writing without undue delay after discovering them, but no later than within 30 days from the date of completion of the given service. For this purpose, it is considered a provided service in the case of:
• Sending an email with accesses to the database and additional educational materials
c) Claims from liability for defects in the provided service expire if they are applied for reasons excluded by the contract and/or these terms and conditions and/or after the warranty period has expired.
d) The buyer is obliged to make claims for defects in the service provided (hereinafter referred to as "complaint") in writing without undue delay after discovering them. In the complaint, the buyer is obliged to state and/or attach:
• the reason for the complaint;
• clear identification of the service provided (name of the tier, etc.);
• day or time and method of detecting the defect/defects;
• clear reason for cancelling
• any unedited audio and/or audio-visual recording.
e) If the seller considers the complaint to be justified, he will provide the buyer, at his choice, with either a reasonable discount from the price of the service without VAT corresponding to the nature and extent of the defects.
9 Copyrights
a) No permission is granted to reproduce any of the materials (information) on Database To Grow website (databasetogrow.com) either for non-commercial or commercial use. You may not:
i. reproduce the materials;
ii. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
iii. attempt to decompile or reverse engineer any software contained on Database To Grow’s website;
iv. remove any copyright or other proprietary notations from the materials; or
v. transfer the materials to another person or "mirror" the materials on any other server.
b) Failing to follow the above will result in legal action.
c) This license shall automatically terminate if you violate any of these restrictions and may be terminated by Diverze Group s.r.o. at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format. Failing to do so will result in legal action.
10 Privacy protection

11 Final and transitional provisions
a) These terms and conditions apply as stated on the Diverze Group s.r.o. website at www.databasetogrow.com.
b) The buyer, who concluded the purchase contract outside of his business activity as a consumer, has the right to withdraw from the purchase contract even without giving a reason. The withdrawal period is 14 days from the day of the order or after 30 if the services did not fulfill the promise mentioned on the website in the section guarantee.
c) Relationships, rights and obligations not regulated by these terms and conditions are governed by Act no. 513/1991 Coll., Commercial Code and other applicable legal regulations of the Slovak Republic. If the relationship established by the purchase contract contains an international element, the parties have agreed that the relationship is governed by the law of the Slovak Republic. This does not affect the consumer's rights arising from generally binding legal regulations.
d) The buyer declares that he has familiarized himself with these general terms and conditions before placing the order and that he agrees with them without reservation.
e) The wording of the terms and conditions may be changed or supplemented by the seller. This provision does not affect the rights and obligations arising during the period of validity of the previous version of the terms and conditions. Any change will be published on the seller's website.
f) Diverze Group s.r.o. may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.
These terms and conditions take effect on 30 October 2023.
